#1 - Introduction & Acceptance of Terms
1.1 These Terms apply to all users of HavocNodes services.
1.2 By accessing or using HavocNodes services, you agree to be bound by these Terms, as well as our SLA, Privacy Policy, and AUP.
1.3 Continued use of HavocNodes services constitutes acceptance of these Terms.
#2 - Eligibility & Age Requirements
2.1 Minimum Age
You must be at least 13 years old to use HavocNodes services.
2.2 Contractual Capacity
You must be 18 years of age or older to enter into binding agreements, purchase paid services, or manage billing. Users aged 13–17 may use services with the explicit consent of a parent or legal guardian. HavocNodes may request evidence of consent but does not routinely verify it.
#3 - Services Provided
3.1 HavocNodes provides the following services.
3.2 HavocNodes may modify, improve, or discontinue services at its sole discretion.
3.3 Service uptime commitments are defined exclusively in the Service Level Agreement (SLA).
• Minecraft Hosting
• VPS Hosting
• Dedicated/Bare Metal Servers
• Web Hosting
• Domain services (third-party)
• Control Panels (Pterodactyl, VirtFusion, HavocNodes Panel)
#4 - Account Responsibilities
4.1 You agree to:
(a) provide accurate registration and billing details;
(b) maintain the security and confidentiality of your credentials;
(c) ensure all activity under your account complies with the AUP and these Terms; and (d) use the services only for lawful purposes.
4.2 You are fully responsible for all actions performed through your account or using your services.
#5 - Payment, Billing & Refunds
5.1 Billing
Services are billed in advance for the selected billing cycle. Failure to pay may result in suspension or termination after a seven (5) day grace period. Subscriptions auto‑renew unless cancelled in the client area prior to renewal.
5:2 Refund Policy
All purchases are final and non-refundable. HavocNodes does not provide refunds under any circumstances, including but not limited to Minecraft Hosting, Web Hosting, VPS, Dedicated/Bare Metal services, add-ons, domains, software licenses, prepaid or bulk billing cycles, or any other products or services offered.
Refunds will not be issued for any reason, including account suspension, termination due to abuse, or violations of our Acceptable Use Policy (AUP) or Terms of Service.
By completing a purchase, you acknowledge and agree that all payments are non-refundable and no chargebacks or disputes will be initiated.
5:3 Chargeback Policy
Any chargeback or payment dispute will result in immediate account termination, irreversible data loss, and possible permanent ban. HavocNodes reserves the right to pursue legal remedies for fraudulent disputes.
#6 - Data Responsibility, Backups & Retention
6.1 Customer Responsibility
You are responsible for all data stored on your service, maintaining backups, securing your applications, and preventing unauthorized access.
6.2 HavocNodes Liability
HavocNodes does not guarantee data retention and is not liable for data loss caused by hardware failure, software corruption, OS reinstalls, node crashes, human error, suspension or termination, or force majeure events.
6:3 Backup Policy
Any backups provided by HavocNodes are best‑effort only and are not guaranteed to be error‑free, complete, or current.
6:4 Data on Terminated Services
Data may be permanently deleted at any time following suspension or termination and cannot be recovered.
#7 - Acceptable Use & Prohibited Activities
7.1 Use of HavocNodes services must comply with the Acceptable Use Policy (AUP).
7.2 The following activities are strictly prohibited and may result in immediate suspension or termination:
• Malware, botnets, or malicious scripts
• Spam, bulk email, or SMTP abuse
• Unauthorized scanning, brute forcing, or penetration testing
• Cryptocurrency mining
• TOR relays or anonymization networks
• Flooding, DDoS, stress testing, or attack tools
• Illegal content (including CSAM, terrorism-related content, hate material)
• High-risk workloads (e.g., stressors, stresser panels, flooders)
• Using Minecraft proxies to access external servers to exploit DDoS protection
• Mass scanning, scraping, or network abuse
• Actions generating upstream provider complaints
7.3 Resource Abuse
HavocNodes may throttle or limit CPU/Network usage to protect infrastructure. Customers are responsible for all actions originating from their services.
#8 - Abuse Handling, Suspension & Null Routing
8.1 Immediate Suspension Triggers
HavocNodes may suspend or null-route without notice for: malware or botnets; DDoS origination; verified abuse complaints; illegal content; brute force or scanning attempts; crypto mining; TOR relays; or actions threatening our infrastructure or other customers.
8.2 24-Hour Response Cases
For issues such as spam or SMTP abuse, the customer will be notified and must respond within twenty‑four (24) hours, failing which suspension may occur.
8.3 Null Routing
HavocNodes may null-route IP addresses if an attack materially impacts other customers or upstream networks.
#9 - DMCA & Copyright Policy
HavocNodes complies with applicable copyright laws, including DMCA‑equivalent procedures.
9.1 Filing a Complaint
Copyright holders may send reports to: abuse@havocnodes.com
#10 - Changes to Terms
We may modify these Terms at any time. Changes are effective when posted to our website. Continued use of the services after changes constitutes acceptance.
#11 - Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction determined by the service provider, without regard to any conflict of law principles. Any rights, obligations, or disputes arising out of or relating to these Terms shall be interpreted, enforced, and adjudicated to the fullest extent permitted by applicable law. The parties agree that any legal action or proceeding shall be brought exclusively in a court of competent jurisdiction, and the parties irrevocably submit to the personal jurisdiction and venue of such courts.

#13 - Service Agreement
1.1 HavocNodes Host agrees to provide game hosting and web hosting services to the Customer as described on our website or in a signed agreement.
1.2 The Customer agrees to use the services in compliance with these Terms and all applicable laws and regulations.
#14 - Account Setup
2.1 Registration Accuracy
You must provide accurate and complete information during registration.
2.2 Credential Security
You are responsible for maintaining the confidentiality of your account credentials.
2.3 Suspension for Inaccuracies
We may suspend or terminate your account for inaccurate, incomplete, or misleading information.
#15 - Additional Policies and Agreements
Use of the Services is also governed by our Privacy Policy, Acceptable Use Policy (AUP), Refund Policy, and any additional agreements such as Domain Registration terms where applicable.
#16 - Account Eligibility (Additional Requirements)
Age Requirement
You must be 18 years or older to purchase paid Services. Guardian‑supervised accounts are allowed where applicable.
Accurate Contact Information
You must provide accurate contact information. Providing false information may result in termination.
Verification
HavocNodes may require identification and payment method verification (e.g., ID and credit card verification) for certain purchases.
#17 - Transfers
We assist with migrations as a courtesy within fifteen (15) days of signup. Outside this window, a fee may apply. No guarantees are made regarding transfer completeness or success. You remain responsible for maintaining backups.
#18 - HavocNodes Content
• All HavocNodes‑provided content (including text, images, and templates) is our property or properly licensed.
• Unauthorized reproduction, distribution, or modification is prohibited.
• Servers suspended for unpaid dues must clear payments before any backup access is considered.
#19 - User Content
You are responsible for all content uploaded, displayed, or transmitted via your account. HavocNodes may take corrective action, including removal or suspension, for violations without refund.
#20 - Compliance with Applicable Law
You agree to comply with all applicable laws and regulations, including GDPR where applicable. You are the Data Controller for any personal data you store using our Services.
#21 - Game Hosting Limitations
• Game hosting performance may vary based on shared resources.
• You must avoid using malicious files/plugins.
• Chunk generation or other heavy‑load tasks must be pre‑approved with HavocNodes support to limit CPU usage.
#22 - Support Limitations
Support covers general server and network issues. VPS services are self‑managed unless critical issues arise. Support is provided via email, live chat, or tickets, and does not include game‑specific configurations unless expressly stated.
#23 - Cancellations and Refunds (Additional Terms)
• Chargebacks without notice may result in immediate service suspension.
• Cancellations must be submitted properly through the billing area to avoid further charges.
#24 - Uptime Guarantee
We target 99.9% uptime. Detailed availability commitments and remedies are defined exclusively in the Service Level Agreement (SLA).
#25 - Service Level Agreement and Credit Policy (Summary)
The SLA applies to network, panel, and DDoS protection incidents subject to its stated conditions and exclusions. Clients may be eligible for service credits in accordance with the SLA. Where applicable and unless superseded by the SLA, credits may be requested by submitting a ticket within seven (7) days of the incident. The total amount of service credits for any month shall not exceed thirty percent (30%) of the monthly fee for the affected services.
#26 - Affiliate Cashouts
Affiliate payouts are processed within fifteen (15) to twenty (20) business days via the selected payment method. A minimum payout balance of $30 is required in order to request a withdrawal. Payouts will not be processed until this minimum threshold has been met.
#27 - Support Rules
When opening a support ticket, you authorize HavocNodes to make necessary changes to resolve the issue unless you explicitly state otherwise.
#28 - Billing and Auto‑Renewals
Subscriptions auto‑renew unless cancelled before the next billing cycle. Customers are responsible for managing cancellations in the client area to avoid further charges.
#29 - Disclaimer of Warranties
Except as required by law, services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non‑infringement.
